one! >> huh? >> where do i sign up? sorry, i can't concentrate but i have to do the headlines. let's kick it off, shall we? last night, the supreme court stopped the execution of a man in texas at the very last minute, dwayne buck was set to be executed for murdering his former girlfriend and her friend 16 years ago. he was actually waiting in a holding cell right next to the death chamber when he heard the news. his lawyers claim racially charged testimony from a psychologist led to an unfair sentence. they're asking now for a new sentencing trial. a shocking turn in the search for susan powell. the police are back tracking that they found remains that could have been hers. they admit they jumped the gun. that site hasn't turned up anything just yet. police will continue to excavate that site this morning. update you now about that deadly listeria outbreak in cantaloupe. colorado woman suing the farm that distributed the fruit claiming it nearly killed her

husband. she's also suing wal-mart where she bought the cantaloupe. >> it's horrible! it's scary. i don't think he'll ever be able to drive again because of the confusion. >> the rocky ford company stopped shipping its cantaloupes to nearly 20 states. if you have one, of course, you're told to throw it out. you've seen the amazing video all week long. remember that biker pinned under a burning car and pulled him out in the nick of time. now he's talking about his brush with death for the first time. >> i wanted to thank all the heroes that put their lives on the line to save mine. when i was under the car, it was completely surreal. i was just like how did i even fit under here? and i just thought i was going to be paralyzed. at best. i should have died when i hit the pavement. i should have died when i hit the car. i should have died when the car

burst into flames. but i didn't! for some reason. and i mean, that just makes life that much more precious to me. >> wow. brandon wright has broken bones and burns. he's looking forward, though, to riding again but now, guess what, he's going to wear a helmet from now on and those are your headlines. how about not -- well, it's up to him whether he wants to ride a bike. maybe i wouldn't. >> it's tough. motorcycles are dangerous to begin with. people want to take the risk. the solyndra scandal is just about done. let's move on to another topic. >> back to patdowns. cool. all right! >> this is unbelievable how bad this is getting and the forensics that they're reconstructing the demise of this solar panel company to find out how a company could be eligible for $537 million in 2009, lose it all, go bankrupt in 2011 and as you read these e-mails, it's pretty clear the white house had plenty of red flags.

>> can i just throw this out here? this is 2009. the white house knew that giving them $535 million, they would have to make it or break it by september of 2011. guess what happened? they ran out of money exactly when the white house knew they were going to. the problem is when you play around with a company that burns through cash that fast, you really are playing venture capitalist which, by the way is at best maybe 1 in 5 or 6 companies make it with our money. they're gambling with our money. they're taking massive risks. that's not what the business of the white house is supposed to be. >> it's not. this was the model company for their energy plan. they needed it to work. >> you know why that's a problem? because steven chu sits atop the department of energy and this is a man who has absolutely no idea what he's doing. this man is lost in the job. >> the federal watchdog group two separate times said the energy department has not developed controls needed to manage the multibillion dollar loan program.

not just the ones at solyndra but they said that we have no idea where this company is going. three separate times, the white house ignored these warnings and sent the president out there to hail its use. >> apparently not internally and now somebody wants the world to know what was going on behind the scenes because they continue to release these e-mails from inside the department of -- the office of management and budget and the white house so this now is between an official from the omb. between two officials there. the optics of a solyndra default will be bad, the timing will likely coincide with the 2012 campaign season heating up. now, is the omb supposed to be a bipartisan group or are the people there appointed by the president? do we know? they're appointed by the president. >> that's an appointment, right. the cbo is bipartisan. the other part of the problem is that they pushed this loan out the door. they expedite it, they got it out the door. mr. obama went to the plant.

said this is what the future of solar is going to look like. if the future of solar looks like 1100 people out of work right now and half a billion dollars of americans taxpayer money down the drain, isn't looking so good. >> the f.b.i. raid they say, the reason it took place last week is because solyndra, they want to find out if solyndra was lying to the government about the solvency of their company. >> before they got the loan. >> before they got the loan and even while they were supposedly expending the loan and expending their company. that's what henry waxman bought up a couple of days ago, let's blame the company for lying to the government and it's not our fault they lied. the f.b.i. seems to be going after that. the other thing is they're looking at the 15 separate loans for a total of $6 billion worth of stimulus money to see if those green dollars went down the toilet as well. >> yep. so i was almost a math major but i'm going to let eric handle the numbers. >> all right. there are $38.6 billion in this

fund alone. there's another fund, i want to talk about the other fund in the next hour maybe but in this fund alone $38.6 billion that is available for these green energy loans to get the jobs going. turns out they've created about 3,545 jobs or so. $20 billion went out the door. so if you take $20 billion that they've loaned out, they've created 3500 and some odd jobs, that comes to $5 million per job. >> so wait a second, 40 different projects. all that money. and the government says, these numbers, 3,445 permanent jobs. you know what they've come back with and said has the administration, well, wait a second, you're not counting the 33,000 jobs we saved at ford by giving them $6 billion in loans to upgrade their -- this is such a stretch. to upgrade their plants in five states, to build more energy efficient vehicles. i'm like wait a second. this is the dog ate my homework! >> right, but that goes back to, remember when the phrase

started coming out, save jobs so now when you look at how they're phrasing it, it's created or saved jobs which many people have spent the last years trying to figure out what a saved job is. >> in february of 2009, joe biden went for the plan, said these are the kind of jobs, these are the permanent jobs that we're going to create with these loans and here we are, two years later, a little over two years later, those 1100 jobs are gone. >> let's look at some other companies that potentially got the stimulus money and have since gone bankrupt. it includes two other green companies. evergreen solar inc. indirectly received $5.3 million through a state grant. inspector watt out of hopewell junction, new york, also now no longer in business and two other companies so this is part of the $800 billion in original stimulus money. >> unbelievable. it's important to noted that evergreen solar was one of the premiere solar companies in the world! i mean, this was a company that everyone -- i'm not sure where they're based. >> it doesn't say.

they blame it on their -- >> everything is going to china. we knew that was happening. you know, we do a lot of this stuff on the business network. we saw it. china was kicking our butt in solar and frankly, we were saying don't invest in these companies because you really risk china undercutting you on price. and that's exactly what happened. >> if i was to headline these two talking points we just went over, it's this. two years ago, our economy was flat on its back. the president said he was going to do whatever he can to start our -- to get our economy back on the right foot. instead of doing that directly, he factored in his agenda. instead of doing the things that are going to stand us up economically, when things started humming along, he said i have a great idea. rahm emanuel probably led this. let's get the green thing going and at the same time take that $850 billion in stimulus money and get our agenda going along with economic healing. >> now it could get more problematic because now you have a top level general, general william shelton announcing now that he may have been pressured

to change his testimony over a white house project. now, he used to be the head of the air force space command and he was going to give testimony about a virginia-based satellite company called light squared. now, apparently, i don't want to get too technical on this. what they wanted to do was come up with a 4g phone network that was going to, you know, surpass any technology we've seen in the world. well, members of the military were concerned that that might affect their gps systems so general shelton was apparently going to go and testify to that. and then he told a closed house committee that in a classified briefing, that he was pressured to change that testimony. now, we don't know who pressured him to do that. we don't know if it was the white house. we don't know if it was the department of defense or the office of management and budget but now that story is starting to percolate. >> they said it's even worse. they said if you want to know what this company was doing, it's like trying to hear a phone conversation in a loud rock concert. and they wanted the general to say this is a solvable part of the 4g network that we're

subscribing to, don't worry about it. it will get on track. the general goes i don't feel that way. i don't think it's going to work. lives are probably going to be on the line. it's factored in the gps. the system factors into the laser bombs. >> apparently this 4g system was so powerful, it would almost eliminate any usefulness of the gps system to the military so they'd have to revamp probably costing us, you know, tens of billions of dollars to fix our own gps system to compete with the airwaves with this light -- what is it, light square ed? >> back to my favorite story of the day, patdowns, the nfl wants to implement the full body patdowns now at stadiums and a lot of people are going to say, oh, my gosh, we'll have to go to the game so much earlier and it will take much more longer to get into the game. thanks to the very few hoodlums at the games that ruin it to everybody. we saw it at opening game last week, the guy with the laser gun, stun gun, whatever it was. thank you very much, you've ruined it for all the family

>> all right, if you think mortgage rates couldn't get any lower, guess again. fixed rate mortgages slid to a 60 year low this week amid growing debt concerns in europe. >> if you're looking to take advantage of that good news, there's one problem, unfortunately, banks still are not lending. stuart varney says that's because they are terrified of regulators. is that true? >> yes, it is true. the regulators are all over the banks big and small saying don't you go out there taking real estate risk. so getting a loan is very, very difficult which is most unfortunate because you just pointed it out. mortgage rates are at, what, 60-year lows and i think they're going to go lower still. 4.09%, the average now on 30-year fixed rate loans. i mean, i've been in america 40 years. i've never seen that before and it's going lower. >> devil's advocate here, isn't giving out loans people who maybe were not credit worthy how we got into this mess arguably? >> that is true. that is absolutely correct.

>> you understand the apprehension of some of the banks. >> i certainly do and they've got the regulators breathing down their next saying don't you take risks like that anymore. that's why it's very difficult to get a loan. look, if you have good credit, a very good credit score, let's say 700, for example, you've got a job, you've got money and you've got a 20% downpayment, you'll probably get a loan. that's not many people. unfortunately, the people who really need these lower rates can't get a loan because they got no equity left in their home, they haven't got a regular job. they've got a poor credit score or something is wrong with that loan and they can't get that rate. it's terrible! >> from your best assessment, have we overcorrected? >> overcorrectein what sense? >> overcorrected with the regulations. first, there was absolutely no regulations. now, i'm seeing -- you seem to think there's maybe too much regulation. >> i don't like dodd frank. that's the name of the financial -- >> does anybody? >> reform act.

there's a lot of factors and sociologists estimate that there's any number of different reasons ranging from the increasing secularization of society and smaller families. 30 to 40 years ago, many catholic families had 7, 10 children. i'm one of seven kids as a matter of fact and usually one or two went into the priesthood or became nuns and now, of course, families are smaller. >> the book is not about that. the book is about a calling. you had a calling. tell us about your calling. >> well, it wasn't something like a thunderbolt, eric. it's a call to be more involved with the church. the more i became involved with our church out in california, the more i realized there were exciting and wonderful opportunities to get involved. almost whatever you like to do, there's something that you can do within the catholic church. >> i was reading, bill, you said after some material success, you started to hear it, you started to feel it. >> i definitely felt it. absolutely. and it's something that grows

within you over time. in the beginning when i was younger, i was a little bit almost embarrassed, i didn't want to admit that, you know, i wanted to be more active in the church. you know, people that i hung around, business people, politicians, you know, they were on the go. and this is what i'm up to. but, you know, i thought boy, maybe there's a little bit more to life. >> what did you do? pele are watching and say i kind of hear that, i feel it a little bit. how did they get involved? what's the first step? >> a good first step is to start going back to church and get involved with the people that are in the pews with you and maybe get to know your pastor. i got to know my pastor in santa monica. he's a great guy and so i said to him, how can i get more involved? and i became more involved with some particular ministries in our church. and, you know, there's areas, there's education now. 97% of teachers in catholic schools are laypeople now. hospitals, there's plenty of opportunities outside the parish, there's plenty of opportunities. inside the parish. i mean, eric, you won't believe.

referendum of the president and i was an unfortunate consequence. if this election happened when the president's poll results were better, i could have turned this around. >> here's the problem with his theory, he actually ran against the president. he would not even come out and say i am for the president's re-election. number one. and number two is anybody accountable for anything anymore? can anyone say, wow, i lost? first, he didn't want to admit defeat. after he was trailing by seven points, he's like well, we want a recount. really? you're not even close and number two, he's got to be embarrassed. you have democrats outnumbering republicans 3-1 and you lost by eight points! >> yeah, but the flip side of that, though, brian is nobody at the white house or debbie wasserman schultz who is the head of the dnc would say it was a referendum on obama so he's the only person who is actually igniting that from his own party. >> that's so important. >> thank you. >> and you're 100% right. debbie wasserman schultz came out the next morning and said by the way, that's always been a tough district.

really? you've had it for 88 years! when did it get tough? it's a referendum on obama and you see more and more democrats going, mr. obama, maybe you want to go to that other district over there before the 2012 elections. i really want to try and win this one. >> i thought this was the era of accountability where we're going to go through budgets line by line and make sure people are accountable for their actions. now you have the president of the united states blaming the tsunami, european economic crisis for our woes. when people lose, they're blaming the president for their woes. when the president is not happy, he blames president bush. what's going on here? let's go to something simple, like the war on terror. top al-qaida operative killed by a c.i.a. drone strike in pakistan. this is the guy. he was said to be the terror group's chief operations -- chief operations officer in that country and he worked closely with usama bin laden and with the pakistani taliban. his job was to inflict pain on american forces. he's dead. >> a special honor for one

military hero. >> today, we pay tribute to an american who put himself in the thick of the fight again and again and again. in so doing, he has earned our nation's highest military declaration, medal of honor. >> president obama placed the medal of honor around marine dakota meyer's neck yesterday. meyer defied orders and went into a killing zone in afghanistan back in 2009 to save 36 lives, both american and afghan troops. meyer also killed at least eight insurgents who had ambushed the troops. >> and the teenager tells police in sante fe, new mexico, that he's robby romero, a boy who disappeared 11 years ago at the age of 7. his d.n.a. is being tested to see if he is that missing boy. he reportedly told police he's been living in a state near new mexico but he wouldn't say who abducted him while he was walking home from a friend awes

angeles programs are more unique in that they have the privilege of working with professional actors. >> they are off broadway actors but today, they're standardized patients playing sick. >> i'm having a cocaine induced heart attack. >> stomach pain, it's actually pancreatitis. >> all fourth year students test their clinical skills in this simulation program. it's a safe practice environment offering real life doctor-patient interaction, much different from textbooks or the classroom setting. >> you say you're really flying solo. usually in medical school, you're doing everything with a team and so you always have someone to back you up if you're not sure about something. >> what you read in the book is always so different from how someone presents to you in real life. it feels like you're in a real patient encounter. it's that stressful. >> the sessions are videotaped so there's instant feedback from the faculty. >> we're observing to see how

students interact with patients. what are they asking in terms of the history questions? what are they doing on physical exam? we just want to make sure that our students are taking the right approach to the patient overall. >> the actors also get to grade these med students who are often nervous. >> i feel for them. i just try to carry on and do the case. >> we're rooting for them but sometimes they miss it. >> better here than in the real world. plus acting sick isn't so bad. >> it sure beats, you know, waiting tables and, you know, driving a cab and tending bar. >> the actors at cornell make $25 an hour and many of them have been doing the same case for years. they say this job has helped them become more aware at the real doctor's office and by the way, the staff at cornell is always looking for more standardized patients to add to the rotation. so if you know anyone who does a really good sneeze or a cough, tweet me. i can hook you up. >> i have so much respect for people who want to be actors. those are the same ones that work at that diner.

light went out at a major intersection. here with us is judge andrew napolitano. judge, this seems like a great thing. traffic is a mess. lights are out. a guy starts directly traffic. what happened? >> the police came and stopped him and gave him a ticket for pretending to be a policeman. he wasn't pretending to be a policeman. this is a traffic spot in pasadena, california, where the light goes out once a week. when it goes out, traffic backs up for a mile. it takes 45 to 60 minutes to come back. the guy on his own got out there and peacefully and appropriately directed traffic, detained and given a ticket for it. no good deed goes unpunished. >> you know what bothers me more, after they get rid of the guy and give him the ticket, they do not stick around and direct traffic so traffic continues, the good samaritan gets the ticket. where's the message here? >> the message is the government is not doing the right thing and you should not be punished for helping the government. in the same week that this happened, we all watched those people lift up that car, that burning car to get the guy out from underneath. did they give them a ticket when the police weren't there? of course not.

look at is the fact that they have large complex, they are highly social and great at problem solving and a variety of other skills but we don't know what that combination of things is exactly that leads dolphins, elephants and certain other animals to possess this ability that we hold quite dear to us. >> you have actually said that if dolphins had lips, they may be able to speak. is that true? >> no, what i said is that dolphins don't have lips but they communicate. all animals communicate but dolphins communicate in ways that we think is rather complex and we're trying to decode what they're doing. >> tell me about your mission now and mainly what you're trying to do in the book is uncover all of the research that we've done and inform people about how smart they are but also to save them. >> yes and that's my main message. my simple message is we need global protection for dolphins and whales. about 1% of the world's oceans are protected. in terms of protecting marine mammal species.

many species are in trouble. we have species of dolphins that are depleted. that means their numbers are reduced. we have animals, dolphins and whale species that are threatening or endangered and these animals are getting hit by stressors, they're being captured for aquariums in certain parts of the world. not in the united states but other parts of the world actually break up dolphin populations in the wild to bring them in to the dolphin program for aquariums and despite the fact that we haven't done that in the united states, many countries still do it and my focus has been on the dolphin drive in japan which were highlighted in the film, "the cove". >> which you had a part of. tell me about that. >> yes, so i've been trying with many of my colleagues to stop these dolphin tribes in japan. these are brutal hunts and unjustifiable killings of dolphins where animals are brought in to this cove, herded in from the wild in their social groups and then they are massacred in the most

unimaginable way. just ripped open alive. the methods have gotten even worse since the film came out. so we need to stop this now. >> so humans love to interact with the dolphins because they are so intelligent so when you bring your kids to these types of water parks where that's available, do you agree with that? >> i actually have strong feelings about this. let me say it very simply, no dolphins should be captured for marine parks, aquariums at all. we should not be capturing dolphins and we should stop killing them. clearly in these drives. as far as aquariums right now, i think the debate is what to do for the future. i don't think it's -- i don't think it's advisable to release dolphins that have been raised in captivity. i think that might be just -- i think it's just not the right thing to do. but i do think that we need to be responsible for those animals and really consider whether we're going to continue to breed dolphins. i would suggest maybe we stop breeding and let aquariums dwindle out. >> very interesting.

released yet. the re-release comes amid reports that filming on "ghostbusters 3" could be starting next year. >> there was a lot of unfinished business in one or two. maybe that's why i wanted to watch the whole movie. maybe we could watch it in the third hour. we did plan something different. one of the things we want to talk about is solyndra. this scandal is growing by the day. many people wonder what happened to the $850 billion that we put out two years ago that we didn't have that was supposed to prime the pump to get the economy back on its feet? much of that money went to green jobs programs and $537 million of that money went to a guaranteed government loan to solyndra. and it has since gone belly up, three separate investigations to find out where the money is and why 1100 people are out of a job. and we're beginning to rebuild forensically through e-mails what went wrong. >> it's interesting because somebody is releasing these

e-mails. somebody wants the story to be told. take a look at this january 31st e-mail out of the office of management and budget between two officials there. the optics of a solyndra default will be bad. the timing will likely coincide with the 2012 campaign season heating up. so is this becoming more political now than we thought? i mean, were they going -- were they pulling out all the stops to make sure this company did not go belly up after receiving that much of taxpayer dollars and more importantly, did they potentially know that this company was already in trouble when they gave them that amount of -- >> even as -- >> go ahead. very quickly, you know, we have to be careful here. there's an investor whose name is george kaiser. he created a foundation, a charitable foundation, that foundation used another entity to buy stock in solyndra. ok? george kaiser also happens to be a major bundler for president obama during the 2008 elections cycle so the question is -- by the way, george kaiser and other officials from solyndra visited

the white house on several occasions, some say four times the week of the loan. some say up to 20 times during, you know, preceding the loan so the question is was the loan put in place to help george kaiser? i'm not speculating on it. i'm simply saying if there's ownership there, wouldn't that be a conflict of interest if one of your bundleers happened to own stock in a company that you were loaning $535 million to? >> what i find amazing is the president was scrambled out there to praise the company for hiring 1,000 people even though there were reports out that shows his company was not healthy. was not viable. when one report came in from a federal watchdog group that said, you know, this solyndra is going -- is having trouble and is not viable, the report from greg -- the retort from greg nelson who works in the energy department seems b.s. it seems like you were wrong. it wasn't b.s. you have 1100 people out of work. they are wondering did they lie to the government? did the government know how bad

it was and didn't pull the plug? >> can i proceed this story down the road a little bit further? two other high profile loans that came in 2009, we haven't talked about, nobody has talked about yet. number one, tesla motors got $465 million to develop an electric car. $500 million. where's the car? it's not out there. >> it's in santa monica in a showroom. >> and the other one, fisker motors, another one $500 million. here's a finnish company from finland. al gore invested in this company, too, and another $500 million loan. where's that? >> where's the car? >> we got -- >> i want our money back! >> when this solyndra story came to be, i was wondering if there was other companies like this that received stimulus cash that maybe now have gone under. guess what? they're starting to come out of the woodwork. here are two other companies that are energy companies that have since gone under after receiving stimulus cash.

evergreen solar inc. received $5.3 million and filed for bankruptcy protection last month. spectrawatt received $500,000 and filed for bankruptcy last month. another filed for protection in 2010 and olson's crop service and olson mills acquisition company received $10 million and filed for bankruptcy protection. first two are energy companies. >> isn't this incredible? this is the whole green jobs agenda that destroyed spain's economy. we thought it was a great idea. let's use the stimulus money that we didn't have. >> it's all about ideology here. >> which is so wrong! >> therein lies the problem. it's about ideology. it's not about actually making investment in a company that's going to create a permanent job. clearly these 1100 jobs weren't permanent. where are we going? we have to wait, this technology will be in place some day but don't risk, especially with the financial condition that the country is in. don't risk our money speculating on whether solar is ready for primetime. it's not ready yet! >> it's amazing. basically our economy was in an

ambulance heading to the hospital and when they opened up the door, instead of getting right to the hospital, they stopped along the way and went to a drive through and they went ahead and bought whatever they got and now we have a situation where the president is asking for $427 billion more after what happened to the last $850 billion. the audacity of that request is beyond comprehension. >> well, especially when the solyndra stuff has come to be in this past week. he asked for it last thursday. so let's see what happens with that. a lot of democrats are not on board with that jobs bill, by the way. in the meantime, there's a high ranking general. general william shelton, head of the air force space command who is supposed to testify about this new company, light squared, a virginia-based satellite company that was developing a new 4g phone network. the general in his prepared remarks was actually going to say that it might be detrimental to the military. >> doesn't work. >> because the way in which it would affect or have problems with the gps of the military. now, he's saying, this general, that he was pressured to change

those comments, to be more lock and step with what may be the white house or the administration wanted to hear about this particular company. so now we've got yet another thing that's starting to percolate. nobody knows yet who pressured him but he's saying that he was pressured. >> they wanted him to say, yeah, it's a problem but it's solvable. he goes, i don't think it's solvable. they all say that. no. and when they started questioning this guy, this general, they wanted the head of the fcc there because he would be the one that would be pushing back on the general but evidently, he was too busy to show up at the hearing. >> and most disturbing of all of it is not whether or not the technology is good or bad or it's going to supersede the military technology is that someone asked him to change his testimony. >> yeah. >> i thought you were under oath when you give testimony. >> he may have been asked prior to that. did he actually testify? i'm not sure he even ended up testifying. >> i don't believe that he did. >> i'll tell you what i am sure about. james carville is ticked at this administration. he knows politics and married a republican. so he really knows both sides of the issues. he's scared that a republican is going to win election and he's

>> we've heard the esident's plan and heard him twice talk about it and finally release it. what's different about what you're offering? >> well, what we're offering is the kind of certainty that the market needs. i think the speaker was absolutely right. when you talk to job creators large and small across this country, they say we don't know what the rules are going to be. we don't know what our taxes are going to be, how high the energy taxes are going to be, what the effect of the health care tax is. the regulations that are coming on board. the more spending that the federal government is going to do. what are they going to do with our competition? they say we can't, we can't hire right now, there's just too much uncertainty so we got to just pull back and tell washington to stop the madness. >> now, you're saying that what john boehner is saying, forget about tax increases. not going to do any type of revenue increases. that's off the table. right away, you're saying to the president, give me an a la carte jobs bill, you're not going to do the whole thing even though the president has not picked up the phone and talked directly to the republican leadership. >> no, look, to believe that the president's program would succeed, one, you'd have to

believe that his first one succeeded and you'd have to believe that taxes aren't high enough, that we don't have enough regulations and washington isn't spending enough. all of those things are flawed. so as the speaker said, look, in order for job creators to create jobs, they have to have some certainty out there in the market and they have to know that the rules of the game aren't going to change in the middle of the process and that's not happening right now which is why we're coming forward this fall in the house and passing a -- a repeal of certain regulations, each and every week. this week, it was the national labor relationsoard bill that we passed a repeal of so that boeing could actually put their manufacturing facility where they want to put it and not where the government wants it. >> as an american, i was personally disturbed that the president has not spoken yet because we're in an emergency situation and name a couple of things where there's common ground. i hear you're for the payroll tax decrease and continuing that. >> i don't think that's necessarily a wise idea. you'd still have to have the social security funds be paid to

>> some quick headlines. first, an update on that deadly listeria outbreak in cantaloupe. a colorado woman now suing the farm that distributed the fruit claiming it nearly killed her husband. the woman suing wal-mart where she bought the cantaloupe. thau there's a reason why your trip home seems shorter than the trip there. it doesn't have anything to do with the familiarity to the route. a study suggests that they're too optimistic about the trip there making it take longer than expected. >> this solyndra scandal continues and it may be the tip of the iceberg? e-mails released last night showed the obama administration privately worried about the effect of a default by solyndra and it's impact on the president's re-election campaign. fox news legal analyst peter johnson jr. is here with more. in that e-mail, it was between two officials at the office of management and budget. they were concerned that maybe this company would go under. >> it's interesting, you see

some of the spin back now. say well, yeah, they were worried about the politics but they were doing it anyway which means it wasn't politically motivated. it was done for the purpose of innovation. you look at the loan programs in the department of energy and you see, i looked at five of them totally $9 billion. the government says for that $9 billion, they will create 206 permanent jobs investing $9 billion. what senator murkowski calculated yesterday and we calculated was she said $5 million a job. i calculated about $4.7 million a job so we're about $300,000 off. so what they've done is create jobs at the rate of $4.7 million per job. >> yes. but even if that sounds outrageous, the problem is those jobs don't exist anymore because companies like solyndra have gone under so those 1100 jobs that were created are now gone.

>> there's two issues. is this incompetence or is it corruption? there's four different investigations going on. there will be more. the larger question is why are we engaging in this? why are we engaging with our tax dollars in a niche venture capitalism and eric was talking about venture capitalism earlier this morning. is that the government's role? should we be investing in companies that don't have a chance of success when we say that we need shovel ready jobs, that we need immediate jobs, when unemployment is 9.1%. when people are hopeless and when the african-american community numbers are sky-high and the hispanic community numbers are sky-high in some places. and so we say no, we have an obligation to pick out certain industries that need our help. but at the same time, they masquerade as economic development, as job creation, as white house pressure that says we need to have the vice

president there for that ground breaking. we need to have the president there for that ground breaking. >> the one thing that you left out in that very extensive list is the ideology of this administration. how does that play into whether or not these companies got loans? >> i think it's a combination of ideology and pay to play and we'll see whether, in fact, any crimes were committed here. when you say i want to create green jobs and that is the mantra of an administration for the economic future of the united states, and you say i'm going to do that at any cost, even if we don't create jobs, even if there's potential conflict of interest with people who are investing in presidential campaigns, even when we abrogate loan agreements and say the government goes last, on repayment, not first. it stinks. it stinks. >> i think we'll leave it right there. that was a good analysis. peter johnson jr. have a fantastic weekend. >> be well. >> see you next week.

really government is too involved. they're stifling job growth and people say, bolling, you're a talking head on a tv network that's conservative and it's not. you're a real life business guy, 34 restaurants. it is, you look five, 10 years down the road, don't you? what do you see when you look five or 10 years down the road? can you see that far now? >> no, we certainly can't see that far down the road in our business, per se, because it's shifting all the time. shifting sands. here's what i think i do say, i also sit on several boards. i sit on two new york exchange stock boards and the perception is that washington is antagonistic towards business. wrong, right or indifferent, that's the perception. we have six restaurants in development now. approximately $20 million of cap ex, we're going forward because we see some opportunities in this particular environment

right now, construction costs or less. >> tell us, though, zane, what is it that would be, you know, i interview a lot of business owners that say i'm not going to hire one employee until i need two. i'll hire two when i need five. what is it, is it health care? is it taxes? is it regulatory environments? what is the most anti-business agenda going on right now? >> it's all the above and plus more. i mean, the nlrb is not a small piece of that whole thing. i don't know if you know or not, eric, i just got it yesterday but all nonunion businesses have to post now in their -- in a prominent place, i think it's two feet by two feet signage telling people how they can join a union. i don't know if that's pro business. >> i haven't heard this before. is this a new york area -- >> no, it's national. it's come out from the national labor relations act. and it's got -- we talk about our deficits, you got to print them. they have to enforce it and they're going to -- you're going to get heavy fines if you don't do these postings and it lists all the ways you can go forward. that creates a perception and

wall collapsed allowing a flood of water to come rushing in. it's believed the men now trapped about 300 feet under ground. and new video of that cruise ship that went up in flames off the coast of norway. crews now trying to prevent it from going completely under. they're pumping water out of the hull. two crew members were killed. nine others in the hospital including two with serious injuries. a fire broke out in the engine room, apparently, police aren't sure what sparked the fire. several popular birth control pills being recalled this morning because of a packaging error. we've listed the effected drugs right there on your screen. the pills were reportedly packaged in reverse order, an error that could result in pregnancy if you take the pills. pharmacy is trying to contact women who may be affected. brad pitt finally opens up about his very public divorce and marriage from jennifer anniston. he tells "parade" magazine that he wasn't living an interesting life with her. and that his marriage to anniston had something to do with it. some took this as brad telling

speaking of damage control, the white house maybe -- >> they should have sat around and getting high. it would have helped. >> now it looks like there are more e-mails coming out, geraldo from the white house, from the office of management and budget saying maybe they knew that this company was going to go under. what are your thoughts about this whole thing? >> right, first of all, i'm not as certain as eric that there's a real rot of legal problems here but certainly, it shows what happens when people are spending money they don't earn. and that's the problem with government programs generally speaking. you have a situation where under ordinary circumstances this half a billion dollars or $535 million loan would never have been made without proper collateral or a business plan that seemed to have a chance. >> if that's a fact, how about this, the nrpg department was told by a federal watchdog group they have not developed any controls to manage the money that they're handing out. so literally, they throw the money out and they go i really have no idea how to follow up on this, it's not my job. >> what's interesting is you point to a flaw within the department of energy and their

lack of controls for this stimulus money they had. they just wanted to get it out the door in a hurry. that's what i mean. there's not the same kind of prudent decision making that there is when it's your money. whether or not it's a crime committed by the solyndra people, i think that will be clear with the investigation. >> talk about that a little bit. you're an investor and you know the stock market inside and out. if there was, this george kaiser, founder of the foundation who used this other vehicle, argonaut to purchase shares, and then this loan comes along and this just so happens to be a big bundler for obama, it certainly smells bad. is it illegal? >> to me, that's the way government does business. who's connected is the one that gets the deal. what's more interesting is whether or not when it's clear the company was going under, whether the taxpayers got rescrewed in terms of, you know, juggling of who got priority in terms of the limited assets, the limited cash the company had

coverage has been or not? >> i think it's been a slow start. it was maybe sloppy and a little lazy. you can't have billions of dollars given out to companies and expect there not to be corruption. so all of a sudden, this has come to our attention. $500 million. now we know there are problems. there are looks to either incompetence or corruption. i think this is the tip of the iceberg and there's a lot more underneath. >> tip of the iceberg for this company or the tip of the iceberg for other loans that were given with taxpayer money? >> other loans. i mean, there is such sloppiness. i think the labor department came out with stats that $19 billion has been mismanaged. i mean, there is so much room for mismanagement and there's no accountability. the problem is these loans are -- the president seems to think that you can throw out loans as a way to stimulate an economy and yet people don't have to pay the loans back. >> uh-huh. leslie, isn't this horrible timing for the president? i mean, he just released his jobs bill. he's asking for almost $500 billion more in stimulus spending. and now won't the american people be scratching their heads

saying, oopsy daisy, some of that money was there the first time around. >> i think the american people are smarter than that, gretchen. quite frankly when you talk about a bill out of the banks that was an american president signed into law. that was agreed ton by both parties, democrats and republicans and the american people didn't want that. what fascinates me, you know, about this is the way i hear it is almost as if we've never had a government left or right invest in a private company ever and that's just not true. we've never had a company go belly up or make investments that are risky. >> you're forgetting the ideology part of this whole equation, though. >> we don't have actual dots that connect. not one congressman left or right has been able to say to any journalist on any network when asked that very question, do you have specific evidence that proves that this is ideologically based and another thing we have to remember is that investors into solyndra, there are many republican and conservative investors

administration. it hasn't been any secret that there have been real fights within the administration that larry summers who was the president's top economic advisor didn't play well with others, that kristina romer, the head of the council of economic advisors, another advisor felt she was kind of pushed aside. there's a little new stuff in there about tim geithner, the treasury secretary that when there were decisions made about things he didn't like, he kind of dragged his feet. i'm not sure that's the real reason that we're in the trouble we're in. i feel, i didn't write a book, but i feel that the real problem is the fact that this administration, when it had the chance, and had a lot of support for its stimulus program turned it over to nancy pelosi and the democratic chairman and they ended up putting a lot of their pent up special programs in that you can argue are good or bad but obviously not very effective in stimulating the economy. >> not good business. in the book, it talks about here we are in an emergency situation

economically and personalities are getting in the way of policy and larry summers being domineering and the women feeling totally marginalized where they were talked over at meetings and they complained to the president about that. that's kristina romer as well as i imagine valerie jarrett who were trying to get a word or two in and they couldn't do it. also, i find it interesting that robert gibbs and david axelrod were whisked away prematurely before anyone thought because president obama wanted to clean house after the midterms. >> yeah and look at how much better things are now. >> yeah. smooth as glass! >> here's a memo that eric is going to read from pete rous. >> i'll read the memo and i want to ask you something about what you brought up. here's the memo from him. it says "there's a deep dissatisfaction within the economic team with what is perceived as larry's imperilous and heavy handed direction of the economic process." here's what i'm getting at here, chris.

all morning long, we've been talking about the head of the energy department, secretary of the energy failing on all these different loans it made to various energy companies. we talk about tim geithner in the past saying don't worry, america will never, will never lose a triple a credit rating. tim geithner saying don't worry about greece, it will never default. is it in house fighting in the white house or is it just complete incompetence at the top? >> i'm trying to think, gee, you put me in a tough spot here. you know, look, i think that there's a -- i don't think the in house fighting has been the real problem here. i think the problem is the decisions that have been made by this administration and some can argue, you know, that hindsight is always 2020 but they obviously haven't worked. it was kristina romer, one of the women cited in the book, the head of the council of economic advisors and i'm sure that everybody regrets that she did this, everybody in administration who said if you pass this stimulus program, we won't get above 8% growth.

well, we have not been below 9% except for two months out of the last two years. so, you know, i don't think it was in fighting. i think they had a policy and the policy didn't work and a lot of it wasn't just, you know, that they made bad policy decisions. i think they made bad political decisions and i go back to turning that stimulus over to the house democrats, i think, was the original sin of this administration and the republicans were in real disarray in early of 2009. i think with a more balanced package and a more moderate package, they could have gotten some republican buy-in. i don't think it would left us with a lot of job loss. the administration would be better politically and in terms of policy if they followed a different course. i think rahm emanuel, the white house chief of staff at the time who was supposedly the big inside washington political guru, i think he made a lot of the mistakes. >> let's take a look. they have another chance now because this super committee, these meetings are going to be coming up and yesterday, some of the senators held a pep rally for them to basically say hey,

let's get the job done. i mean, they have a short period of time, chris, they have to -- these 12 members of the house and senate have to come up with $1.5 trillion in cuts not to mention the president's jobs bill that flopped on top of that. they have to come up with that before thanksgiving. is it going to happen? >> i think it's going to be awfully hard. you have to add one other thing to the equation, gretchen, that's this trigger. if they don't do that as part of the debt deal, there's automatic triggers including half a trillion dollars in cuts for the pentagon which leon panetta told congress yesterday there would be a disaster for the military security, national security of this country. they're in a very tough spot. again, you know, there's a deal that can be made but both sides have to compromise and at this point, they have very different philosophies, utterly different philosophies by the government as part of the solution or the main problem, i don't know how they get from here to there and as you said, they got less than two months because it has to be scored by the cbo once they get it. they really have about two

father-in-law continue to be free. if you're an investigator, without remains, so far, you have nothing. >> the fact, brian, that they are trying so hard and they've done several searches in the desert area, in mines, two cadaver dogs hit on a scent in this area 30 miles from where he allegedly went camping in the middle of that blinding snow storm. that was recently disturbed suggests that there was something there. but they found no hair, no forensics but they will continue to search. the law enforcement on this case is very determined. and the fact that the father of the victim and the father of the josh powell are getting mutual orders of protection against each other, trashing each other, we've got court orders, protecting her diaries. it's a sad commentary on what's going on between these two families. >> when your wife is missing and you react by insulting them, that gives you a clue maybe, you're perhaps involved.
